These terms and conditions (the “Terms”) govern the contractual relationship between you as a customer and Sikmo ApS. By using our services or products, you agree to these Terms. We recommend that you read the Terms carefully.
Terms and Conditions of DANMAG (Sikmo Aps)
1. General
These terms and conditions (“Terms”) apply to all services provided by Sikmo ApS (CVR No.: 43675796), hereinafter referred to as “DANMAG”, “we” or “us”. By using our services, the customer (“you”) agrees to these Terms.
2. Basis of agreement and conclusion of the contract
The agreement between DANMAG and the customer comes into force when the customer places an order through our website, accepted our offer send by email or other approved channel. Prices calculated through our online price calculator are binding, provided that the information you have entered is correct and complete. Incorrect or incomplete information may result in changes in the agreed price.
3. Scope of services
We provide professional painting and renovation services. The scope of the work is specified in the order confirmation, which is sent after the order has been placed. It is your responsibility to ensure that all information on which the work is based is correct.
4th. Price and payment
4.1. Prices: All prices are stated in Danish kroner (DKK) and include VAT and materials unless otherwise stated.
4.2. Payment Terms: Payment must be made according to the payment schedule stated in the order confirmation. In case of late payment, interest is charged in accordance with the provisions of the Interest Act. We offer installment plans according to individual assessment. If you are not registered in RKI or similar databases, an installment plan is offered according to individual assessment.
Sikmo ApS Installment is an installment plan where you pay for our services or other services over 6 months. Your first payment of Sikmo ApS Installment will be charged when sending your order. In connection with the creation of installments, you will be enrolled in automatic payment. Automatic payment must be made using a registered debit card when sending your order. The APR is 12%, but there are no fees or credit costs associated with the agreement on Sikmo ApS Installment.
You can pay the residual purchase amount at any time if the installment plan is to be completed. In case of late payment, Sikmo ApS is entitled to charge interest from the end of the payment deadline and until payment is made in accordance with the provisions of the Interest Act. Sikmo ApS is also entitled to send a withdrawal letter and a debt collection notice in case of late payment of your bill. Sikmo ApS reserves the right to terminate your Sikmo ApS installment agreement after sending a withdrawal letter and a debt collection notice, requiring immediate payment of all remaining installments and termination of your Sikmo APS subscription agreement.
5. Delivery, execution and schedule
5.1. Delivery: We strive to complete the work within the agreed timeframe. Any delays due to unforeseen circumstances will be notified to the customer immediately.
5.2. Customer's responsibility: It is your responsibility to ensure access to the work site and prepare the work area, as agreed in the order confirmation. If the work ordered is not sufficient to complete the task in a workmanlike manner, we will inform you of this before starting the work. After that, the price will be adjusted on the spot or by phone, text or email. Usually we show additional prices for various tasks in our pdf offer, so subsequent settlement for extra work or more coats of paint than what was ordered will be settled based on these prices unless otherwise agreed.
6. Right of withdrawal and cancellation
6.1. Right of withdrawal: According to the Consumer Contracts Act, you as a consumer have a 14-day right of withdrawal when purchasing services. However, the right of withdrawal ends when the work has begun with your express approval.
6.2. Cancellation: You can cancel a service free of charge if the cancellation occurs within 48 hours before the agreed start date. In case of later cancellation, we reserve the right to collect compensation for lost working time.
7. Complaints and Liability
7.1. Complaint: Any defects in the work performed must be notified to us in writing within a reasonable time and no later than 14 days after the defect is discovered. We reserve the right to correct the defect at no additional cost to you.
7.2. Limitation of Liability: We are not responsible for indirect losses, including operating losses, lost work profits or the like. Our liability is limited to the amount you paid for the service in question.
8. Personal Data Handling
We collect and process your personal data in accordance with our privacy policy and applicable data protection legislation. The purpose of the collection is to manage your order and ensure the proper performance of our services.
9. Disputes and redress
If a dispute arises between you and us, you can lodge a complaint with the Centre for Complaints Resolution or the Consumer Complaints Board via naevneneshus.dk, if the conditions for this are met. Disputes must be settled in accordance with Danish law and in Danish courts.
10. Choice of law and jurisdiction
All agreements between DANMAG and the customer are governed by Danish law. Any dispute must be dealt with in the court of our home municipality unless otherwise agreed.
